ON SOME ISSUES OF ENFORCING LIABILITY BY COURTS FOR VIOLATION OF ELECTORAL RIGHTS

Abstract

Background. The electoral right is one of the most important, basic segments of the constitutional law of the Russian Federation. Being the aggregate of legal norms, the electroral right regulates organization and holding of elections in order to let citizens exercise their right to elect or to be elected into the state authority and local self-government bodies, i.e. regulates the most important institutions of the democratic state. The main goal of the study is to analyze the existing problems of enforcing iability by courts for violation of the electoral right, and to suggest possible ways to solve the problems.
Materials and methods. The articles analyzes the Federal law from 10.01.2003 № 19-FZ (edition of 28.12.2013) “On election of the President of the Russian Federation”, the Federal law from 18.05.2005 № 51-FZ (edition of 28.12.2013) “On election of deputies of the State Duma of the Federal Assembly of the Russian Federation”, Decrees of the Constitutional courts of the Russian Federation, definitions of corts of the Russian Federation subjects. Besides, the author uses summary statistical data on thestate of conviction in Russia in 2012; summary statistical data on activity of the federal courts of general jurisdiction and the justices of the peace in 2012; summary statistical data on the state of conviction in the first half of 2013; summary statistical data of activity of the federal courts of general jurisdiction and the justices of the peace in the first half of 2013.
Results. Violations of citizens’ electoral rights apply to the category of major socially-significant crimes, committing of which provides for constitutional-legal, administrative and criminal liability by the law. In some cases the liability for violation of citizens’ electoral rights may also include the civil-legal liability.
Conclusion. Improvement of the legislation, regulating the issues of juridical liability for violation of electroral rights, is of freat importance. Only provided the precise legislative regulation it is possible to administrate justice meeting the principles of fairness and equity.
